Rechtliche Grenzen und Chancen der Liquid Democracy auf kommunaler Ebene

  • Angesichts mangelnder Wahlbeteiligung und zunehmender Politikverdrossenheit stellt sich die Frage nach alternativen Methoden zur Revitalisierung der deutschen Demokratie. Eine der hierzu entwickelten Theorien ist die der Liquid Democracy. Wo sich bisherige Forschung größtenteils mit politikwissenschaftlichen Fragen beschäftigt hat, soll diese Ausarbeitung einen Einblick in die rechtlichen – insbesondere die verfassungsrechtlichen -Fragen bieten, die Liquid Democracy aufwirft. Dazu wird aus der sehr allgemeinen Liquid-Democracy-Theorie eine eigenständige Demokratietheorie, die Cooperative Liquid Democracy, entwickelt, in der neben einem Liquid-Democracy-Organ die kommunale Vertretung bestehen bleibt. Es werden zudem auch Fragen des NKomVG, der NV und des GG beantwortet. Diese Ausarbeitung setzt seinen Fokus auf die Beantwortungder Frage nach der Abschaffbarkeit der Vertretung, der Machtverschiebung von der Vertretung auf die Bürger und nach der Möglichkeit der Durchführung von Online-Wahlen. Dabei werden aktuelle Urteile des Bundesverfassungsgerichtes berücksichtigt. Der Autor setzt sich, zum Teil sehr kritisch, mit den Ausführungen der Gerichte und der Literatur auseinander und kommt zum Ergebnis der generellen Vereinbarkeit der Cooperative Liquid Democracy mit der Verfassung. Zudem werden praxisnahe Empfehlungen und Hinweise gegeben, um die Theorie der Cooperative Liquid Democracy anschaulicher darzustellen und eine Umsetzung in der Praxis anzuregen.
  • Low turnouts in elections and a growing disenchantment with politics beg the question of alternative methods to revitalize the German democracy. One theory developed to do so is Liquid Democracy. Where past research has mainly been focused on questions related to political science, this paper is going to focus on the legal, mostly constitutional, issues that arise from implementing Liquid Democracy. A new theory is developed from the very broad idea of Liquid Democracy called Cooperative Liquid Democracy. In said theory, the local councils still remains intact and is only complementedby a liquid democracy institution. This paper also answers questions regarding the law concerning the constitution of municipalities in the state of Lower Saxony (NKomVG), the constitution of the State of Lower Saxony (NV) and the constitution of the Federal Republic of Germany (the Grundgesetz) (GG). The paper will focus on the questions of the ability to replace the local councils all together, the shift of power from councils to the citizens and of the possibility of electronic elections. Current verdicts of the Federal Constitutional Court of Germany (Bundesverfassungsgericht) are included in the author’s considerations. The author does discuss the courts decisions and literature and concludes that Cooperative Liquid Democracy would generally be constitutional. Additionally practical recommendations and hints are given to depict the theory of Cooperative Liquid Democracy more lively and to encourage implement Cooperative Liquid Democracy in the field.
